1.1    These general terms and conditions apply to purchase contracts with private customers, which are concluded via this website of the provider. LENI ADAM is a brand of ADAM Uhren Bijouterie, Hübelistrasse 19, 4600 Olten. All contracts are concluded with the ADAM Uhren Bijouterie („provider“).

1.2    The order is confirmed by the provider. The contract is concluded as soon as the the buyer receives a confirmation. If the confirmation does not occur within a reasonable period, the buyer considers this as a rejection of the order and is entitled to conclude the contract with another supplier.

1.3    By visiting this website and buying on this site, you agree to the following terms and conditions. Please read these terms and conditions carefully before you are using this homepage. The provider reserves the right to change the terms and conditions or to replace parts of the terms and conditions. The user of this site is responsible to inform himself periodically about changes on this page.

1.4    The products are hand-made for the customer and prepared for delivery as soon as the payment for the goods has arrived.

2.1    All prices are listed in Swiss Francs. The VAT is included in the quoted price. Shipping costs will be charged extra. 

2.2    In the case of deliveries abroad, customs fees may occur which are not borne by the supplier but by the customer.

2.3    The provider reserves the right to change prices at any time. The prices published on the website on the order date apply for the customers.

3.1    The provider endeavors to present the jewellery as clearly as possible on the pictures of the homepage. However, there is no guarantee that the appearance of the products will be the same on all displays. The color of the gemstones and gold alloys may differ slightly from the original product.

3.2    The provider gives no guarantee that the piece of jewellery meets the expectations of the customer.

3.3    The descriptions, images and prices of the products may be subject to change by the provider at any time. In addition, depending on its availability, products can be removed from the site at any time.

3.4   Customers and users of this site are not informed about changes according to 3.3.

3.5  Products can be changed or removed from the site at any time.

4.1 The Provider reserves the right, but is not obliged, to exclude or limit the sale of products to any person. The Provider may, at its discretion, limit or cancel the quantities per person, household or order. These restrictions may include orders made by or under the same customer account, same credit card, and / or orders using the same billing and / or shipping address.

4.2 In the event that an order is changed or canceled, the provider may attempt to notify you by contacting the email and / or billing address provided at the time of the order.

4.3 The provider reserves the right to restrict or prohibit orders placed at its discretion by dealers, resellers or retailers.

5.1   Delivery usually takes place in 4 weeks within Switzerland. If a longer delivery period is necessary, the customer will be informed at the latest after this time has expired. If no information is given, the customer is entitled to waive the delivery. The paid amount will then be refunded by the provider.

5.2   Deliveries abroad may take longer depending on the destination

5.3   Delivery shall be made under the condition of punctual and proper self-delivery by our suppliers. In the event of force majeure, such as strikes and other industrial action, riots, war, natural disasters, as well as the manufacturer's or subcontractors' blocking of deliveries, there shall be no delay in delivery. The seller shall not be liable for delays in delivery caused by manufacturers or third parties. 

5.4   The Provider’s performance is an obligation to send. This obligation is fulfilled with the handover of the ordered product to the transport company. After dispatch, the risk of accidental deterioration and accidental loss of the product passes to the customer. The provider is not responsible for any fault of the transport company used.

6.1    The customer can cancel the purchase contract within 7 days without giving a reason and without a penalty charge. The provider offers the return of all purchased products within 7 days of receipt of the products.  

6.2    The jewellery has to be returned unworn, in the same condition as upon receipt and in its original packaging. 

6.3    Returns will only be accepted if an email has been sent to info@leniadam.ch within this time. If LENI ADAM has not received an email within 7 days after receiving the goods, the right of return expires.

6.4    Shipping costs, customs duties and all other costs incurred for the return of the products are not covered by the provider and must be fully borne by the customer.

6.5    Please address your return to: Adam Uhren Bijouterie, Hübelistrasse 19, 4600 Olten, Switzerland.

6.6   The returned goods will be inspected by the provider upon receipt. The provider reserves the right to refuse a return if the conditions mentioned above are not met. 

6.7    The money, minus any costs incurred for the return, will be transferred to the account used for the payment of the jewellery. 

7.1    The supplier gives a warranty of 12 months that the goods have the warranted characteristics, that they have no defects affecting their value or suitability for the intended use, and that they conform to the prescribed services and specifications.

7.2    LENI ADAM grants a one-year warranty on the jewellery. The warranty lasts 360 days from receipt of the jewellery.

7.3    The warranty is only valid for normal wear and does not cover cases in which the jewellery has been damaged, distorted or scratched.

7.4    The warranty does not apply if the item has been repaired, in the meantime, by someone other than the provider.

7.5    Please send an email first with your name and a photo of the damaged jewellery to info@leniadam.ch.

7.6   The provider reserves the right to refuse repairs under warranty if the conditions of Art. 7.2, 7.3, 7.4 and 7.5 are not met.

7.7    Delivery costs are not covered by LENI ADAM. However, there is the possibility to bring the jewellery directly to the atelier of LENI ADAM and to collect it there. 

8.1    The customer ist obliged to check the delivered products as soon as it is feasible after the usual course of business and to inform the provider within 5 business days since receipt of the product of any detected defects by sending a picture to info@leniadam.ch.  If you fail to do so, the products shall be deemed approved. 

8.2    If there is a defect, the buyer has the choice to demand elimination of a defect (remedy) or to withdraw from the contract.

8.3    The customer’s right to reduction of the purchase price is excluded. 

8.4    The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the buyer or third parties or defects due to external circumstances.

9.1    The Provider undertakes to ensure up-to-date security in systems, programs, etc. that belong to him and over which he has an influence, as well as to follow the rules of data protection.

9.2    Customers must ensure the security of systems, programs and data which are within their control. In their own interest, customers should keep passwords and user names secret from third parties.

9.3    The provider is not liable for defects and malfunctions that he is not responsible for, especially not for safety defects and operational failures of third party companies, with whom he works or on which he is dependent on.

9.4    Furthermore, the provider is not liable for force majeure, improper action and neglect of risks on the part of the customer or third parties, excessive use, inappropriate equipment of the customer or third parties, extreme environmental influences, interference by the customer or third parties (viruses, worms, etc.) which may occur despite the necessary current security arrangements.

10.1    This Agreement and all legal relationships hereunder are governed by Swiss Law. The United Nations Convention for the International Sale of Products (CISG) is not applicable. With regards to consumer contracts, this choice of law applies only to the extent that the protection granted by mandatory provisions of the law of the state in which the consumer has his habitual residence is not withdrawn.

10.2    Jurisdiction is the domicile of the provider.
